Return and Refunds Policy

Withdrawal Rights

Buy safely and simply with CREA.
Your purchases are protected by the withdrawal rights.
Orders may be fully or partially returned and a refund may be asked within 8 days from the date of receipt.

“Return” conditions are bound by the following return procedures:

Download the “Withdrawal form”, fill in all its parts and send it back to acquisti@crea-store.it.
A member of our team will then contact you to help with the return procedures.
Please remember the products must be returned in their original conditions, not damaged and in the package of origin. Returning costs will be at your complete charge.

Refund Rights and Product Exchange

Once the package arrives in our warehouse, it will be checked to verify the compliance to the return procedures”.
If no problems are encountered, we will refund the related amount sending a written communication to your registered e-mail address.
Refund will take from 48 hours up to a maximum of 45 days depending on the chosen procedure. We shall not be held responsible for any delay that may occur during the refund process.

SALES CONDITIONS

Definition of Purchase

When registering to the website, the customer accepts the herein Condition of Sales besides all other directives that rule on the use of this Site, including informative on Data Protection Act.
Every single order sent by a customer (here thereafter called “Client”) constitutes a contractual proposal of the Client and, therefore, it will be binding only if, and when, confirmed by:

1. Order Acceptance.

CREA will be sending an order confirmation via e-mail after verifying its completeness and correctness and checking that all ordered items are available in stock.
The contract is deemed concluded when the confirmation e-mail sent by CREA reaches the Client mail server.

The General Conditions are governed by Legislative Decree 9 April 2003, n. 70 which implements the Directive 2000/31 / EC on certain legal aspects for services given by information societies, with particular reference to electronic commerce.

CREA reserves the right to change the General Conditions at any time without prior notice. However, the changes will have no effects on the purchase orders that have been sent before the publication of the changes on the Site.

The contract will be filed through an electronic system and will be accessible to the CREA personnel who needs to be acknowledged in connection to the performance of the contract. It will also be accessible to any third parties needed by CREA for the execution of the contract and to legitimate recipients under current legislation.

By sending the order the Client agrees to CREA on the use of the phone, e-mail and other automated calling systems without the intervention of an operator in relation to the conclusion and execution of the contract.

2. Acceptance of General Conditions

By flagging the “I accept the Terms and General Conditions” box that is shown during the online registration, the Client accepts all conditions of the agreement here thereafter, in addition to those provided in the purchasing procedure itself.

In the absence of express acceptance of the General Conditions, you will not be allowed to complete the registration process / on-line purchase.

By accepting the General Conditions and, therefore, with the issue of the order, the Client agrees to all communications to be sent and received via e-mail. The Client will be held responsible for the correct e-mail address and all the information entered at the time of issuance of the order or the opening of the account.

3. Payment Methods

The Client shall send payments through Paypal Credit Card Service by following the steps stated on our website, filling in the form correctly with truthful data.

The order despatch will occur once the payment has reached CREA Bank Account.

4. Deliveries

All costs of delivering the products are charged to the Client and are specified in the order confirmation.
Unless otherwise indicated, all deliveries are intended to the ground floor.

Terms and conditions indicated by CREA refer to the products available at the warehouse and, despite being carefully checked, they are not binding for CREA, which can then confirm or modify them, depending on the actual availability.

Any delay in delivery of less than 60 (sixty) days shall not entitle the Client to refuse the delivery of products, or to claim damages or compensation whatsoever.
In case of delays in the excess of sixty (60 days) the Client shall have the right to cancel the order and receive a refund of amounts already paid, without the right to any refund or further compensation.

The e-mail of confirmation will include all necessary documentation required by the articles 3 and 4 of the Decree. In any case, the Client may obtain this information by consulting the website and downloading this document containing such information for printing or archiving.

5. Guarantee

The guarantee is provided against any manufacturing defects and is limited to the repair or replacement of any recognized defective components or products. This is valid for returned goods, carriage paid, within 12 months from the date of purchase as stated on the invoice. Exclusions are applied to any defects caused by normal wear and tear, improper utilization, by a lack of maintenance or any tampering. The guarantee is provided only to fully-paid goods.

6. Withdrawal Rights

Under Article 64 of the Decree, the Client (if it qualifies as a ‘end user‘ pursuant to art. 3 letter ‘a‘ of the Decree) has the right to withdraw the contract and return the products ordered by downloading the provided forms from the website and filling them out for the said procedure using the stated guidelines.

The right of withdrawal must be exercised by the Client, subject to forfeiture, by sending a certified email to CREA at acquisti@crea-store.it within 8 (EIGHT) working days from the receipt of the goods.

AFTER THE WITHDRAWAL FORM HAS BEEN SENT, all returns must be authorized and approved by CREA which will issue an authorization number for the returns.

Once this number is received, the Client may return the product to the address stated on OUR EMAIL of authorization.

Returns must be carried out within eight days from receipt of the authorization number.

The Client will be fully liable to pay carriage costs and no countersigned consignments will be accepted.

Once goods are received together with the purchase invoice, their integrity is verified and no damages are found, CREA will be proceeding with the refund within the shortest possible time in compliance to the terms of the art. 67 of the Decree in this matter. The refund will be corresponding to the value of returned products, retaining, if necessary, the amount of shipping costs not being paid by the Client. These costs will be permanently at Client’s charge.

Withdrawal Rights cannot be exerted by the Client in the event of damaged products.

7. Limitation of Liability

CREA disclaims any liability to the buyer or any third party for any indirect, incidental, consequential, punitive or exemplary damages (including, but not limited to, loss of profits, revenues, business opportunities) arisen from or in connection with a product or a service provided by CREA, or rather the use or the impossibility to use the product itself. CREA will not be held responsible for any problems due to force majeure such as accidents, explosions, fires, strikes and / or riots, earthquakes, floods and other events that could prevent, in whole or in part, the completion within the agreed timing.

CREA shall not be liable to any party for any damages, losses and costs incurred as a result of failure to execute the contract for the reasons above mentioned, in which case the Client has the only rights to a refund of the paid price.

With no prejudice to the case of fraud or gross negligence of CREA, it is therein agreed that, if CREA is found liable in any way to the Client, including the case of default, in whole or in part, to the obligations granted to the Client by CREA following the execution of an order, the responsibility of CREA will not be exceeding the price of the products purchased by the Client and for which the dispute has arisen.

8. Client Liability

The Client must verify that all its data are truthful, complete and up to date, and any variation shall be notified immediately.
In the event of false statements all benefits provided by the service offered will be annulled.

CREA reserves the right to cancel any data of subjects who provide incorrect or false information from their lists of customers when a formal invitation to correction is not accomplished.

9. Jurisdiction

These Terms are governed by Italian laws. Without prejudice to the applicability of mandatory provisions of law for the protection of the consumers (as defined pursuant to Art. 3 letter “a” of the Decree) in reference to the competent court (art. 33 paragraph 2 letter “u” of the Decree), any dispute not related to consumers, related to these Terms and Conditions, will be under the sole and exclusive jurisdiction of the Court of Lecco.
